Hearing, Tuesday, June 2, 2009
PRESENT: Adrienne Pfluger, Bob Royce, Bill Parish, Vice-Chairman; Arnold Henson, Chairman; Judith Bruce, George Christie, Harry Herrick, (Members); Steve Phillips, James Trainor, Jamie Balliett, (Associate Members); and Jennifer Wood, Conservation Administrator.
The Meeting opened at 8:30 a.m.
NOTICES OF INTENT
Gregory DeLory, 124 Namequoit Road. Proposed conversion of 2 concrete patios to decks. Work will occur within 100’ of a Coastal Bank & within the Pleasant Bay ACEC. Mr. DeLory said he is the Owner and the designer of this project. Arnold Henson said wood is better than impermeable concrete, and the only expansion of these decks is outside the ACEC and greater than 75’ to the coastal bank.
MOTION: A motion to approve this project was made by Bill Parish and seconded by Bob Royce.
VOTE: Unanimous.
Colonial Gas Co. (dba National Grid), Cedar Land Road by Coastal Engineering Co., Inc. Proposed gas main extension. Work will occur within 100’ of 2 Bordering Vegetated Wetlands. Brad Malo, from Coastal Engineering Co., said the Plan was revised to show the ditch between the 2 wetlands. The proposed gas main extension will be along the western edge of Cedar Land Road and will cross Seaside Drive. It will continue toward Beach Road outside of the buffer. At the closest point, the line will be 10 to 12’ from one of the wetlands. This work will be within the grassy shoulder of the road between the pavement and the guard posts. Straw bales will be set among the guard posts. Arnold Henson asked why straw bales are being used instead of silt fence? Mr. Malo said he could ask
for silt fence. This work will take a day. An 18”-wide trench will be dug for the line. The pavement on Seaside Drive may be cut and patched afterward, or they may go under the pavement. Arnold Henson said he was concerned that residents on Seaside Drive would have their access cut off. Mr. Malo said half of the road would be done at a time to prevent that. Judith Bruce asked if the line could be put on the other side of Cedar Land Road? Mr. Malo said no—part of the gas line is already on this side of the road. Bill Parish asked if the disturbed area would be seeded? Mr. Malo said yes. George Christie said with the gas line installation on Loomis Lane, the straw bales were left in place for a year. Arnold Henson said the Order could be conditioned that silt fence is used instead. Steve Phillips said the Plan states the bales will be removed immediately. Judith Bruce said there are no steep slopes so
removal of the straw bales could occur immediately. More information will be brought in about whether silt fence or straw bales are preferable in this location. Jenny Wood listed an Abutter’s questions. Mr. Malo confirmed the trench will be 18 to 23”-wide. He said there will be no disturbance to the Abutter’s property as the work is within the roadbed. Mr. Malo said there will be no impact on the wetlands if the gas line breaks because gas dissipates into the air. It will not leach into the wetlands. The work will begin after the Order has been issued and the appeal period is over—at least a month. Jenny Wood said these Orders for gas lines are not being recorded on a specific property and the Certificates of Compliance are not being requested. She said she would like to wait for input on how to record or condition them from Town Counsel. Mr. Malo said he would request the outstanding Certificates of
Compliance and submit As-Built Plans.
MOTION: A motion to continue this Hearing to the Meeting on June 9, 2009 was made by George Christie and seconded by Bill Parish.

ADMINISTRATIVE REVIEWS
Town of Orleans (Friends of Arey’s Pond), John Kenrick Woods Extension.
This is a proposal for an Osprey nesting pole on the Conservation Property to be maintained by the Friends of Arey’s Pond. The site is to be inspected for suitability by Bob Prescott and others from the Audubon Society. The Representative for this proposal is Gussie McKusick.
MOTION: A motion to approve this Administrative Review was made by George Christie and seconded by Judith Bruce.
VOTE: Unanimous.
Marvin and Jane Corlette, 49 Chestnut Drive. This is a request to remove 6 dead red cedars and replace them with red cedars, white cedars and tupelos. The cedars have been affected by the bark beetles.
MOTION: A motion to approve this Administrative Review was made by Bill Parish and seconded by Bob Royce.
VOTE: Unanimous.
Alison Ferring, 199 Namequoit Road. This is a request for a proposed change in the waterline location 2’ within the 100’ buffer to the coastal bank. This change is necessary to have 10’ between the connection for the septic system and the waterline.
MOTION: A motion to approve this Administrative Review was made by Bill Parish and seconded by Judith Bruce.
VOTE: Unanimous.
LIAISONS TO COMMITTEES
Reappoint Judith Bruce to the Wastewater Management Steering Committee for Fiscal Year 2010.
MOTION: A motion to reappoint Judith Bruce as liaison to the Wastewater Management Steering Committee for Fiscal Year 2010 was made by George Christie and seconded by Bill Parish.
VOTE: Unanimous.
Reappoint Harry Herrick to the Community Preservation Committee for Fiscal Year 2010.
MOTION: A motion to reappoint Harry Herrick as liaison to the Community Preservation Committee was made by Judith Bruce and seconded by Bob Royce.
VOTE: Unanimous.
